In Volume Two of Ernest Fortin: Collected Essays, Fortin deals with the relationship between religion and civil society in a Christian context: that of an essentially nonpolitical but by no means entirely otherwordly religion, many of whose teachings were thought to be fundamentally at odds with the duties of citizenship. Sections focus upon Augustine and Aquinas, on Christianity and politics; natural law, natural rights, and social justice; and Leo Strauss and the revival of classical political philosophy. Fortin's treatment of these (...) and related themes betrays a keen awareness of one of the significant intellectual events of our time: the recovery of political philosophy as a legitimate academic discipline. We considered the question of how corporate social responsibility differs between Canada and the U.S. Prior research has identified that national institutional differences exist between the two countries [Freeman and Hasnaoui, J Business Ethics 100:419–443, 2011], which may be associated with variations in their respective CSR practices. Matten and Moon [Acad Manag Rev 33:404–424, 2008] suggested that cross-national differences in firms’ CSR are depicted by an implicit–explicit conceptual framework: explicit CSR practices are deliberate and more strategic than implicit CSR practices. We compared Canada and U.S. CSR and examined how CSR strategic alliances, CSR reporting, and CSR performance in the two countries correspond to implicit versus explicit CSR practices, which we link to stakeholder and signaling perspectives. We relied upon a new database, the Sustainalytics Global Platform, and we found a positive association exists between CSR strategic alliances and the number of years that firms have issued standalone CSR reports in both countries. Moreover, we found that CSR scores mediated this association in the U.S., as U.S. firms with high CSR scores typically engage in more CSR strategic alliances. In Canada, we did not find this mediating effect. Our findings suggest that U.S. firms engage in signaling activities that are more strategic and explicit than their Canadian counterparts. . This paper examines the association between long-term compensation and corporate social responsibility for 90 publicly traded Canadian firms. Social responsibility is considered to include concerns for social factors and the environment, 564-578; Kane, E. J., 341-359). Long-term compensation attempts to focus executives efforts on optimizing the longer term, which should direct their attention to factors traditionally associated with socially responsible executives. As hypothesized, we found a significant relationship between the long-term compensation and total CSR weakness as well as the (...) product/environmental weakness dimension of CSR. In addition, we found a marginally significant relationship between long-term compensation and total corporate responsibility. Our findings are that executives long-term compensation is associated with a firms environmental actions, and that firms that utilize long-term compensation are more likely to mitigate product/environment weaknesses than those that do not. Implications for practice and research are discussed. (shrink)

In Aleksandr Solzhenitsyn, Daniel Mahoney presents a philosophical perspective on the political condition of modern man through an exegesis and analysis of Solzhenitsyn's work. Mahoney demonstrates the tremendous, yet often unappreciated, impact of Sozhenitsyn's writing on twentieth century thinking through an examination of the writer's profoundly important critique of communist totalitarianism in a judicious and original mix of western and Russian, Christian and classical wisdom.

In the United States, a longstanding legal rule exists against patenting natural phenomena. The Supreme Court recently had an opportunity to help define the boundaries and clarify the implications of this “natural phenomenon doctrine” in Laboratory Corporation of America v. Metabolite Labs., dismissed as improvidently granted. This article argues that the natural phenomenon doctrine renders both the patent claim at issue in LabCorp, and the patents that directly or indirectly claim biological correlations between genotypes and medical phenotypes, invalid or unenforceable (...) under U.S. patent law. In this book, distinguished French philosopher Pierre Manent addresses a wide range of subjects, including the Machiavellian origins of modernity, Tocqueville's analysis of democracy, the political role of Christianity, the nature of totalitarianism, and the future of the nation-state. As a whole, the book constitutes a meditation on the nature of modern freedom and the permanent discontents which accompany it. Central to his own fruitful study of modern society and politics, of the stakes and twists-and-turns of the dramatic twentieth century, was Raymond Aron's fifty year engagement with `Marx and Marxism'. In a series of lecture courses (and elsewhere) Aron provided a comprehensive, balanced, and judicious exposition and appreciation of Marx's intellectual itinerary. On one hand, Marx helpfully highlighted various tensions in liberal-bourgeois society. On the other hand, however, his apolitical, materialistic explanations of them and, especially, his prediction of capitalism's (...) explosive self-overcoming proved grossly inadequate. In addition to being a special sort of social scientist, Marx was a Promethean humanist who rejected all natural and social limits and who claimed to scientifically predict the coming of the true and real City of Man. Aron's own `balanced social analysis' and his humane, sober, reformist thought stand in stark contrast. (shrink)

We explore the extent to which Boards use executive compensation to incite firms to act in accordance with social and environmental objectives (e.g., Johnson, R. and D. Greening: 1999, Academy of Management Journal 42(5), 564-578; Kane, E. J.: 2002, Journal of Banking and Finance 26, 1919-1933.). We examine the association between executive compensation and corporate social responsibility (CSR) for 77 Canadian firms using three key components of executives' compensation structure: salary, bonus, and stock options. Similar to prior research (McGuire, J., (...) S. Dow and K. Argheyd: 2003, Journal of Business Ethics 45(4), 341-359), we measure three different aspects of CSR, which include Total CSR as well as CSR Strengths and CSR Weaknesses. CSR Strengths and CSR Weaknesses capture the positive and negative aspects of CSR, respectively. We find significant positive relationships between: (1) Salary and CSR Weaknesses, (2) Bonus and CSR Strengths, (3) Stock Options and Total CSR; and (4) Stock Options and CSR Strengths. Our findings suggest the importance of the structure of executive compensation in encouraging socially responsible actions, particularly for larger Canadian firms. This in turn suggests that executive compensation can be an effective tool in aligning executives' welfare with that of the "common good", which results in more socially responsible firms (Bebchuk, L., J. Fried and D. Walker: 2002, The University of Chicago Law Review 69, 751-846; Zalewski, D.: 2003, Journal of Economic Issues 37(2), 503-509). In addition, our findings suggest the importance of institutional context in influencing the association between executive compensation and CSR. This Festschrift in Professor Kristeller’s honor consists of contributions by scholars who have had some connection with Columbia University, his "intellectual home in the United States for three decades." It also includes a Tabula Gratulatoria listing many other friends from the United States and Europe. The editor’s opening essay provides an interesting and informative account of this scholar’s academic career, and should be read together with the complete annotated bibliography of his publications through 1974. The latter lists 149 "major publications" (...) and 220 "minor publications." Kristeller’s contributions to the history of Renaissance philosophy are well known to historians of philosophy, and deservedly so. Here reference should be made to his groundbreaking studies on Marsilio Ficino and Pomponazzi, and on others such as Pico della Mirandola and Petrarch, as well as on Renaissance Platonism, Aristotelianism in the Renaissance, Thomism in the Renaissance, Paduan Averroism, and Alexandrism. But he has also contributed greatly to the fields of medieval and Renaissance history, and especially to our understanding of Renaissance humanism, Renaissance music, and Renaissance art. He is universally recognized as one of the world’s foremost authorities on manuscript research, as is witnessed, for example, by the cooperative project, Catalogus Translationum et Commentariorum, which he founded, and by his Iter ltalicum. In all of these enterprises he has set an enviable example for other scholars by the exacting standards and the breadth of his expertise. It is only fitting, then, that the many essays in this Festschrift should reflect the breadth and depth of the scholarship so evident in the man to whom they are dedicated. Background Empirical studies of surrogate decision-making tend to assume that surrogates should make only a 'substituted judgement'—that is, judge what the patient would want if they were mentally competent. Objectives To explore what people want in a surrogate decision-maker whom they themselves select and to test the assumption that people want their chosen surrogate to make only a substituted judgement. Methods 30 undergraduate students were recruited. They were presented with a hypothetical scenario about their expected loss of mental capacity in (...) the future and asked to answer some questions about their choice of surrogate. These data were analysed qualitatively using thematic content analysis. Results Most respondents talked about choosing someone who was caring and competent in certain ways, giving interesting evidence for their judgements. Surprisingly few highlighted how well they thought their chosen surrogate knew their preferences and would be able to make a substituted judgement. Moreover, few specified that their chosen surrogate had similar attitudes and values to their own and so would make a similar decision to theirs in the circumstances presented. Some respondents also referred to the social role of their chosen surrogate or the social dynamics of their situation which influenced their choices, as well as to ideas of reciprocity and characteristics of honesty and loyalty. Conclusion In the event that they lose mental capacity, many people will not select a surrogate to decide about medical treatments on their behalf solely on the basis that they expect their surrogate to make a substituted judgement. Context: Philosophical debates in recent decades have developed new ways of dealing with old philosophical problems such as reality, truth, knowledge, language, communication, and action. These new approaches deserve serious consideration because they can improve the discourse of radical constructivism. Problem: This paper discusses the following problem: How can we overcome dualistic and ontological approaches to basic philosophical problems – problems that are relevant to all scientific domains? Method: The method applied here can be roughly described as a transition from (...) entities/substantives/identities to actions and processes, the actions and processes from which so-called entities result. Action-orientation – or an actor-based process – is necessarily combined with sense-orientation as provided by culture and society. Results: The paper demonstrates how the problems mentioned above can be reformulated in a non-dualistic and non-ontological way. Implications: Opening up constructivist thinking to insights provided by neighbouring philosophical approaches facilitates interdisciplinary cooperation and helps overcome dualistic remnants – as well as the cognitive one-sidedness of traditional constructivism. The early Schelling and the romantics constructed the unconscious in order to overcome the modern split between subjectivity and nature, mind and body, a split legislated by Cartesian representationalism. Influenced by Boehme and Kabbalah, the later Schelling modified his notion of the unconscious to include the decision to be oneself, which must sink beneath consciousness so that it might serve as the ground of one's creative and personal acts. Slavoj Zizek has read the later Schelling's unconscious as a prototype of (...) Lacan's reactive unconscious, an unconscious that only exists as the excluded other of consciousness. This reading, though close to the text of Schelling, misses something essential: the unconscious for Schelling is not a repression but a condition of the possibility of life and love. (shrink)

In this paper the authors argue that research ethics committees should not be paternalistic by rejecting research that poses risk to people competent to decide for themselves. However it is important they help to ensure valid consent is sought from potential recruits and protect vulnerable people who cannot look after their own best interests. The authors first describe the tragic deaths of Jesse Gelsinger and Ellen Roche. They then discuss the following claims to support their case: competent individuals are epistemologically (...) and ethically in the best position to say which risks are reasonable for them, so RECs should be no more restrictive than the “normal” constraints on people taking risks with themselves; RECs do not judge individual competence ; individual liberty is mostly limited by what serves the public interest, and RECs do not determine public interest; RECs may have a paternalistic role in preventing exploitation of competent people vulnerable to the use of incentives, and in protecting the interests of incompetent people; however, the moral and political authority of RECs has not been established in this respect. Increasingly, medical students are required to face up to ethical issues in their training and practice. At the same time, there is growing interest in philosophy courses in the ethical issues raised by medical practice. This textbook, designed primarily for students of medicine, develops the issues to a philosophical level complex enough to be satisfying to students of philosophy as well as MA students on applied ethics courses. The author advocates an approach to medical ethics which breaks out of the (...) straitjacket of the narrow choice between utilitarian or deontological theory, and contains a valuable discussion of practical wisdom. It maintains a balance between case studies and philosophical arguments - which are developed in a historical context, and will be of interest at all levels of the medical profession. (shrink)
